These Terms of Sale ("Terms") govern every order placed on the Drainae website (the "Site") with HKG Lab, operator of the Drainae brand ("Drainae", "we", "us"). Placing an order constitutes full acceptance of the Terms in force on the date of the order, which are available on the Site at all times and may be saved by the customer.
1. Scope
These Terms apply to remote sales of products (dietary supplements and accessories), subscriptions and access to the Drainae app to consumers. Products are for personal use only and may not be resold. We may refuse or cancel any order from a suspected reseller, any order showing signs of fraud, or any order exceeding reasonable personal-use quantities.
2. Products and health information
Drainae drops are a dietary supplement, not a medicine. These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure or prevent any disease. A supplement is not a substitute for a varied, balanced diet and a healthy lifestyle. Do not exceed the recommended daily dose. Keep out of reach of children.
Not recommended, without prior medical advice, for pregnant or nursing women, persons under 18, persons allergic to any ingredient (including the legume family, e.g. clover), persons with a history of hormone-sensitive cancer, liver or kidney disease, or persons taking medication. If in doubt, consult your healthcare provider before use.
Results vary from person to person depending on age, lifestyle, health status and consistency of use. Reviews, photos and testimonials reflect individual experiences and are neither a promise nor a guarantee of results. Product photos are for illustration purposes.
3. Orders
The customer selects products, reviews the cart and total price, corrects any errors, then confirms the order with an obligation to pay. The contract is formed when we send the order confirmation email. An automatic acknowledgment does not constitute acceptance while a fraud review is pending.
We may cancel an order, with a full refund, in case of an obvious pricing or description error, product unavailability, payment failure, suspected fraud, or incomplete or incorrect shipping information. The customer warrants that they are the holder of, or authorized to use, the payment method used, and that the information provided is accurate.
4. Prices and offers
Prices are shown including applicable taxes in euros, or in the currency of the shipping market (converted and rounded). US prices exclude any applicable sales tax, which is calculated at checkout. Shipping is free on all orders. Prices in effect at the time of the order apply. Promotional offers (bundles, discounts, gifts, countdown offers) are valid while stocks last and for the stated period, and cannot be combined unless stated otherwise. "Free" items included in a bundle have no separate refund value.
For deliveries outside the European Union, customs duties, import taxes and clearance fees may be charged by the destination country and are payable by the recipient.
5. Payment
Payment is due at the time of order, by credit or debit card, Apple Pay, Shop Pay, PayPal or any other method offered at checkout. Payments are processed by certified providers; we never have access to your full card details. For subscriptions, the customer authorizes automatic charges to the saved payment method at each renewal (Section 7), including after the card issuer automatically updates the card details.
Before disputing a charge with their bank, the customer agrees to contact our customer service, which aims to resolve any complaint within 48 business hours. In case of an unjustified dispute (product delivered according to carrier tracking, subscription not cancelled), we will provide the bank with evidence of the order, delivery and acceptance of these Terms, and may suspend pending orders and subscriptions.
6. Shipping
Shipping methods, areas and timeframes are detailed in our Shipping Policy. Stated timeframes are estimates. Carrier tracking showing delivery to the address provided by the customer constitutes proof of delivery, unless proven otherwise.
7. Subscriptions
Subscriptions (Drainae drops, Drainae app) are governed by our Subscription Policy, which forms an integral part of these Terms. In short:
- subscriptions renew automatically at each billing date (every 2 months for drops), at the current subscriber price, until cancelled;
- you may cancel at any time, in a few clicks, from your customer account or via our contact form or at contact@drainae.co, no later than 48 hours before the next billing date;
- the subscriber price (25% off) is granted in exchange for a minimum commitment of 2 deliveries. If you cancel before your 2nd delivery ships, an early cancellation fee applies, equal to the discount you actually received on the delivery or deliveries already received (the difference between the one-time price and the subscriber price paid). No other fee applies. This fee does not apply if you exercise a statutory right of withdrawal, use our money-back guarantee, or cancel because of a failure on our part;
- free app trials convert to a paid subscription at the end of the trial unless cancelled before it ends.
8. Right of withdrawal (European Union customers)
Consumers residing in the European Union have 14 days from receipt of the products to withdraw without giving any reason. They must notify us of their decision through an unambiguous statement via our contact form or at contact@drainae.co, or using the model form in Section 14, then return the products within 14 days of that notification, at their own cost.
Exception: the right of withdrawal does not apply to sealed goods which are not suitable for return due to health protection or hygiene reasons and which were unsealed after delivery. Bottles whose safety seal has been opened are therefore excluded from withdrawal (they remain covered by our money-back guarantee, Section 9). For digital content and services (Drainae app), by accessing the app immediately the customer requests performance before the end of the withdrawal period and waives the right of withdrawal for the part already performed.
Refunds are made within 14 days of the withdrawal notice, to the original payment method, and may be withheld until we receive the products or proof of shipment. They include the original standard shipping costs.
9. 30-day money-back guarantee
In addition to statutory rights, Drainae offers a 30-day money-back guarantee from delivery of each customer's first order, under the conditions set out in our Refund Policy: request via our contact form or at contact@drainae.co with the order number, return of the bottles (even opened or empty), refund of the price paid for the products. It is limited to one use per person and per household and does not apply to subscription renewals or to purchases made from sellers other than the official Site.
10. Statutory warranties
Independently of the commercial guarantee, customers benefit from all statutory warranties applicable in their country of residence (in the EU, the 2-year legal guarantee of conformity and the warranty against hidden defects). Products that are defective or damaged on delivery are replaced or refunded free of charge.
11. Liability
We are not liable for non-performance caused by the customer, by an unforeseeable and insurmountable act of a third party, or by force majeure. We are not liable for use of the product contrary to the directions on the label and the Site. Nothing in these Terms limits our liability where the law does not allow it. For customers residing in the United States, the limitations set out in Section 7 of our Terms of Service apply.
12. Personal data
Data collected when you order is processed in accordance with our Privacy Policy.
13. Complaints, mediation and governing law
Complaints should be sent via our contact form or at contact@drainae.co. EU consumers may, in case of an unresolved dispute, refer the matter free of charge to the consumer mediator: the mediator we are registered with, whose details are available on request at contact@drainae.co. These Terms are governed by French law, without prejudice to the mandatory provisions of the consumer's country of residence. Customers residing in the United States are subject to the individual arbitration provisions of our Terms of Service.
