These Terms of Service govern access to and use of the Drainae Site and the Drainae app. By browsing the Site, you accept them. Purchases are also governed by our Terms of Sale.
1. Health information
Content on the Drainae Site, app, emails and social media (articles, exercises, plans, tips) is provided for general information and wellness purposes. It is not medical advice, diagnosis or treatment and does not replace consultation with a healthcare professional. Consult your doctor before starting any dietary supplement or exercise program, especially if you are pregnant, nursing, ill or taking medication. Stop any exercise that causes pain.
These statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure or prevent any disease. Individual results may vary.
2. Account and security
You are responsible for keeping your login details confidential and for all activity on your account. You must be at least 18 years old to place an order.
3. Intellectual property
The Drainae brand, logos, texts, photos, videos, illustrations, the app and all Site content are protected by intellectual property laws. Any reproduction, extraction or use without prior written permission is prohibited.
4. Reviews and user content
By posting a review, photo or other content, you warrant that it is genuine, based on your own experience and does not infringe anyone's rights. You grant us a non-exclusive, royalty-free, worldwide license, for the duration of the rights, to reproduce, adapt and publish it on our channels, including advertising, with your first name and last initial. Only customers who purchased the product can post a review; we do not pay for reviews; negative reviews are not removed for that reason alone.
5. Prohibited conduct
You may not use the Site for fraudulent purposes, attempt to compromise its security, scrape its data, resell our products without authorization or impersonate anyone. We may suspend access for any user in breach.
6. Disclaimer and liability
We strive to keep Site information accurate and the Site available, but cannot guarantee it is free of errors or interruptions. Links to third-party sites are for information only. To the extent permitted by applicable law, we are not liable for indirect damages arising from use of the Site.
7. US residents: individual arbitration and class action waiver
For customers residing in the United States only, and to the extent permitted by law: any dispute will first be subject to a 30-day informal resolution attempt in writing via our contact form or at contact@drainae.co; failing that, it will be resolved by individual, binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except for claims eligible for small claims court. YOU AND DRAINAE WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS OR REPRESENTATIVE ACTION. You may opt out of this arbitration provision by notifying us in writing within 30 days of your first purchase. To the extent permitted by law, Drainae's total liability to a US resident is limited to the amount paid for the order concerned, and the Site and products are provided "as is" except for express warranties stated in our policies. You agree to indemnify Drainae against third-party claims arising from your breach of these Terms. This section does not apply to consumers residing in the European Union or the United Kingdom, who retain all their statutory rights.
8. Changes
We may update these Terms; the version online when you use the Site applies. Orders remain governed by the Terms of Sale accepted at checkout.
9. Governing law
These Terms are governed by French law, without prejudice to mandatory provisions of the consumer's country of residence and to Section 7 for US residents.
